1. Scope

These general terms and conditions (GTC) apply to all orders placed via the Vauxelier online shop. They regulate the contractual relationship between Vauxelier and the customer in the context of the sale of goods via online trading. Deviating conditions of the customer are not recognized unless Vauxelier expressly agrees to them in writing.

2. Conclusion of contract

The presentation of the goods in the online shop does not constitute a legally binding offer, but rather a non-binding invitation to order. By submitting the order, the customer makes a binding offer to conclude a purchase contract. The contract is only concluded when Vauxelier expressly confirms the order by email.

3. Prices and payment terms

All prices quoted are in euros and include the applicable statutory VAT. Shipping costs are shown separately during the ordering process. Vauxelier offers the following payment methods:

  • credit card
  • PayPal
  • advance payment
  • direct debit (SEPA)
  • invoice (after credit check)

The purchase price is due immediately upon conclusion of the contract. In the event of non-payment, Vauxelier is entitled to charge default interest at a rate of 5% above the base interest rate.

4. Delivery and Shipping

Delivery is made to the delivery address specified by the customer during the ordering process. Vauxelier delivers within Austria and to the other countries specified in the online shop. The shipping costs and the expected delivery times are displayed during the ordering process.

If the ordered goods cannot be delivered for reasons beyond Vauxelier's control (e.g. force majeure, unavailability of the product), the customer will be informed immediately. Any payments already made will be refunded immediately.

5. Right of withdrawal

Consumers have a legal right of withdrawal. Customers can cancel their order within 14 days without giving any reason. The withdrawal period begins on the day on which the customer or a third party designated by them takes possession of the goods.

To exercise the right of withdrawal, the customer must send a clear declaration (e.g. by email or in writing) to Vauxelier. The return costs are borne by the customer, unless otherwise agreed.

Consequences of revocation:
In the event of an effective cancellation, Vauxelier will reimburse the customer the purchase price and the delivery costs (except for the additional costs resulting from a different, more expensive delivery method) within 14 days of receipt of the returned goods.

6. Returns and Exchanges

The goods must be returned in their original condition, unworn and in their original packaging. Vauxelier reserves the right to refuse a refund if the goods are not returned in perfect condition. Certain items, such as underwear or hygiene products, cannot be returned if they have been opened or worn.

7. Warranty and Liability

The statutory warranty rights apply. The customer is obliged to report obvious defects in writing within 14 days of receiving the goods. Vauxelier is liable without limitation for intent and gross negligence as well as for injury to life, body and health.

Vauxelier is only liable for minor negligence in the event of a breach of essential contractual obligations (cardinal obligations), the fulfilment of which is essential for the proper execution of the contract and on whose compliance the customer can regularly rely. In these cases, liability is limited to foreseeable damage.

8. Retention of title

The delivered goods remain the property of Vauxelier until the purchase price has been paid in full. In the event of late payment, Vauxelier is entitled to withdraw from the contract and reclaim the goods.

9. Data Protection

The customer's personal data is processed by Vauxelier exclusively within the framework of the statutory provisions of data protection law. The data collected is only used to process the order and, if necessary, to contact the customer in the context of contract processing. 10. Applicable law and place of jurisdiction

All legal disputes arising from or in connection with the contractual relationship between Vauxelier and the customer are subject to the laws of the Republic of Austria, excluding the UN Convention on Contracts for the International Sale of Goods. If the customer is a merchant or has no general place of jurisdiction in Austria, the place of jurisdiction is Vauxelier's registered office in Vienna.

11. Severability Clause

Should individual provisions of these General Terms and Conditions be invalid or unenforceable, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by an effective provision that comes closest to the economic purpose of the invalid provision.
